This Agreement ("Agreement") is between you ("User") and DesignDuoAI ("Company") for the use of the services of DesignDuoAI ("Service").

2. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these terms and conditions and our Privacy Policy. If you do not agree with any part of these terms, you must not use the Service.

3. Service Description

The Service allows users to generate Figma designs from text descriptions. The Service is provided "as is" and "as available" without warranties of any kind.

4. User Responsibilities

4.1 You must provide accurate and complete information when using the Service.

4.2 You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

5. Usage Restrictions

5.1 You may not use the Service for any illegal or unauthorized purpose.

5.2 You may not attempt to reverse-engineer, decompile, or disassemble the Service.

6. Intellectual Property

6.1 All content generated by the Service remains the intellectual property of DesignDuoAI.

6.2 You are granted a non-exclusive, non-transferable license to use the designs generated by the Service for personal or commercial purposes.

7. Payment, Cancellation and Refunds

7.1 The rates and fees for the Service are subject to change without notice.

7.2 All payments are non-refundable except as required by law.

8. Termination

8.1 We reserve the right to terminate or suspend your access to the Service at our sole discretion, without notice, for conduct that we believe violates these terms or is harmful to other users of the Service, us, or third parties, or for any other reason.

9. Limitation of Liability

To the maximum extent permitted by law, DesignDuoAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Service;
• Any unauthorized access to or use of our servers and/or any personal information stored therein;
• Any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our Service by any third party;
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
